MAP Wins Over Ingham County Sheriff in Arbitration

The Ingham County Sheriff's Department's last  best offer regarding wages and retroactivity was  adopted in the Act 312 Arbitration Award by Arbitrator Barry Ott, however the employer failed to pay four MAP members what they were entitled to receive. The award language was very clear: "No retroactive payment of wages will be made prior to February 27, 2004, and then only to those employees on the date of the Act 312 Award."

Each of the members were either promoted or transferred out of the bargaining unit, however all remained employees of the Sheriff's Department. It took another arbitrator to force the payment they were

 

entitled to. The Employer, in their stated position to Arbitrator William P. Daniel, took that award to mean the members had to "continute their employment in the unit."

This position was clearly wrong, and Arbitrator Daniel ordered all four members their clearly deserved retroactive pay. Attorney Catherine Farrell, representing the MAP members said, "The Arbitrator correctly found these grievants were to be properly paid."
